IP & DMCA Takedown Policy

AgriEx (Agriexchange.com) respects the intellectual property rights of others and expects users of the platform to do the same. This policy explains how rights-holders can notify us of alleged infringement on listings, seller profiles, images, product descriptions, reports, uploaded documents, or other content hosted on Agriexchange.com, and how we handle those notices.

Although AgriEx is a South African platform and not established in the United States, we voluntarily follow a takedown process modelled on the U.S. Digital Millennium Copyright Act (DMCA) for all copyright, trademark, and related intellectual-property complaints, regardless of where the rights-holder is based.

You can submit a takedown notice for content that you believe:

• Reproduces your copyrighted work without permission (photos, product images, catalogue text, reports, videos, logos).
• Uses your registered or common-law trademark, brand name, or logo without authorisation.
• Was scraped, copied, or re-listed from your own website or catalogue without a licence.
• Falsely represents that a seller is affiliated with, endorsed by, or a distributor of your business.
• Otherwise infringes a right you own or are authorised to enforce.

If your complaint is not about intellectual property (e.g. defamation, misleading claims, safety issues, or fraud), please use the Contact page or the "Report listing" function on the listing itself instead.

Send your notice by email to support@agriexchange.com with the subject line "IP Takedown Notice". Your notice must include all of the following:

1. Your identification. Full legal name, company name (if applicable), postal address, phone number, and email address.
2. The work or right you own. A clear description of the copyrighted work, trademark, or other right, and — where relevant — a registration number or a link to the original.
3. The infringing material. A direct URL on agriexchange.com to each listing, seller profile, image, or page you are reporting. Screenshots alone are not sufficient.
4. A good-faith statement. A statement that you have a good-faith belief that the use of the material is not authorised by the rights-holder, its agent, or the law.
5. An accuracy statement. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights-holder or authorised to act on their behalf.
6. A signature. A physical or electronic signature (typed full name is acceptable).

Incomplete notices may be rejected or delayed. Do not send documents containing sensitive personal data beyond what is necessary to identify you and the right you are asserting.

When we receive a properly formed notice we will typically:

• Review the notice within a reasonable time (usually within 5 to 10 business days).
• Where the complaint appears valid, remove or disable access to the reported material.
• Notify the seller or user who posted the material, including a copy of the notice (with sensitive contact details of the complainant redacted where practical) so they can respond.
• Keep an internal record of the notice, our decision, and any counter-notice for audit purposes.

Removing content is not an admission of liability by AgriEx or by the user who posted it. We do not adjudicate the underlying legal dispute; where the facts are unclear we may leave content up and direct the parties to resolve the matter through their own legal channels.

If your content was removed and you believe it does not infringe — for example because you own the rights, have a licence, are the original photographer, or the use is otherwise lawful — you may submit a counter-notice to support@agriexchange.com with the subject line "IP Counter-Notice".

Your counter-notice must include:

1. Your name, address, phone number, and email address.
2. Identification of the material that was removed and the URL where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the courts of the Republic of South Africa (and, if the complainant is outside South Africa, to service of process from the complainant or their agent).
5. Your physical or electronic signature.

If we accept a counter-notice, we may restore the material after a reasonable waiting period (typically 10 business days), unless the complainant informs us that they have filed a legal action seeking a court order.

AgriEx maintains a policy of terminating, in appropriate circumstances, accounts that are the subject of repeated valid infringement notices. Depending on the severity and frequency, we may also:

• Suspend the seller from creating new listings.
• Revoke a "Verified seller" badge.
• Refuse to onboard the same business under a different account.
• Report the matter to the relevant authorities.

Submitting a materially false notice or counter-notice — for example, claiming rights you do not have, or targeting a competitor's lawful listing — may expose you to liability for damages, including costs and attorneys' fees, under South African and foreign law. AgriEx reserves the right to decline to act on notices that appear to be abusive, competitive harassment, or otherwise made in bad faith.

Some listings on AgriEx are compiled from publicly available sources and clearly labelled as "Public source" with a link back to the original seller's website. If you are the owner of such a business and would like us to remove your public-source listing or profile — even without alleging infringement — email support@agriexchange.com with the subject line "Remove public-source listing" and the URLs you would like removed. We will honour reasonable requests promptly and without requiring a formal DMCA notice.
